What is your current setup?
Did you try resetting the machine as described in the manual?
If that doesn't work I would think about taking it back.
I don't think the firmware may help you.

What audio drop outs are you talking about?
I'm running 1.3 with no problems. Many here are also.
Try not to take what a few write as gospel for everything across the board.
